These Terms of Use and End User License Agreement (collectively, the "Agreement") and all documents referred to in them constitute a legally binding agreement between you as a natural person ("you", "your" or "User") . ) and Pulse Record ("we" or "our"), in connection with your access to and use of the "Pulse Record" software application (the "Application") on your mobile device. Please read this Agreement carefully before downloading, installing or using the Application.

It is important that you read and understand this Agreement, because downloading, installing, or using the Application indicates that you have read, understood, agreed to, and accepted the Agreement, which is effective from the date you download, install, or use the Application. By using the Application, you agree to be bound by this Agreement.

If you do not agree (do not accept) this Agreement, or you do not agree to at least one term of this Agreement, you are not authorized to access, download, install or use the Application. You must immediately stop downloading, installing the Application, and Delete (delete) the App from any mobile device you own or control.

Changes to this Agreement

We reserve the right to change or modify this Agreement at any time and for any reason at our sole discretion. We will keep you notified of any changes by updating this Agreement, and you waive your right to receive specific notice of each such change. It is your responsibility to review this Agreement periodically to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Agreement by your continued use of the Application after the date such revised Agreement is posted.

In order to download, install, access, or use the Application, you must be eighteen (18) years of age or older.

All users who are minors in their jurisdiction of residence (generally under the age of 18) must have the permission of and be under the direct supervision of their parent or guardian to use the App, therefore, if you are between the ages of 13 and 17 , and you wish to use, download, install, access the Application, before you do so you must: (a) ensure and confirm (if necessary) that your parent or guardian has read and agreed (obtain your Obtain parental or guardian consent) this Agreement; (b) have the authority to enter into binding contracts with us and are not prohibited by any applicable law.

Parents and guardians must directly supervise any use of the Application by minors. The Application may not be downloaded, installed, accessed or used by anyone under the age of 13.

The app allows you to track your blood pressure data by measuring your heart rate using your fingertips and your phone's camera. Please see the full list of capabilities on the application page.

This application is for your personal, non-commercial use only. You may only use the Application for the purposes stated above.

Subscription

Once the user (you) downloads the app, he or she can use its basic functionality. A paid subscription is required to unlock premium services. When you cancel your subscription, you can still use the basic functionality of the app.

1、Payment will be charged to the payment method submitted at confirmation of purchase. You authorize us to charge the applicable subscription fee to the payment method you use.

2、You can choose from different subscription options. Different subscription plans and duration information are displayed to you.

3、Your subscription will automatically renew within 24 hours before the end of the current subscription. Subscription renewal and cancellation can be managed in the Apple App Store. (Please note that deleting the app will not deactivate your subscription.)

Your privacy is very important to us. Therefore, we have developed a privacy policy so that you can understand how we process, use and store information, including personal data. Access to the Application and use of the Service is subject to the Privacy Policy. By accessing the Application and continuing to use the Services, you will be deemed to have accepted the Privacy Policy and, in particular, you will be deemed to have acknowledged the manner in which we process your information and the appropriateness of the processing of your information as described in the Privacy Policy Legal Basis. policy. Terminate User License Agreement

You may only use our applications for your own non-commercial purposes. You are obliged to respect the copyrighted material in the application and you cannot sell the images provided in the application.

Prohibited behavior

You agree not to use the Application in any way:

- Is unlawful, illegal or unauthorized;

- Defame any other person;

- Obscene or offensive;

- Infringe any copyright, database right or trademark of any other person;

- Advocate, promote or assist any illegal conduct, such as (by way of example only) copyright infringement or computer misuse.

You may not make the Application available to any third party. In addition, you may not modify, translate into other languages, reverse engineer, decompile, disassemble, or otherwise create derivative works from the Application or any documentation related to the Application.

You may not transfer, lend, rent, lease, distribute this Application, or use it to provide services to third parties, or grant any rights to this Application or any documents related to this Application to third parties.

Misuse of any Trademarks or any other content displayed on the Application is prohibited.

You may not directly or indirectly infringe our intellectual property rights by copying and/or copying and/or distributing and/or publishing and/or using any content within the Application.

Additionally, you may not attempt to use the Application, or portions thereof, for malicious purposes.

Additionally, we are not responsible for how you use the App.

To be clear, we may take any legal action we can take in accordance with applicable law against users who violate this Agreement.

All disputes arising out of the use of the Application shall be governed by and construed in accordance with the laws of the United States of America and shall be submitted to the exclusive jurisdiction of the competent courts located in the State of New York, United States of America.

YOU AGREE THAT USE OF THE APPLICATION AND ITS SERVICES IS AT YOUR SOLE RISK. THE SERVICES AND ALL MATERIALS, INFORMATION, SOFTWARE AND CONTENT INTEGRATED IN THE APPLICATION ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. We make no warranties of any kind, express or implied, as to the merchantability, technical compatibility or fitness for a particular purpose of any services, products or materials provided hereunder. We do not warrant that the functions contained in or through the Services will be available, uninterrupted, or error-free, that defects will be corrected, or that the Services or the servers that make them available are free of viruses or other harmful components.

Our products are not medical products and cannot be used for medical purposes. If you feel unwell and worried about your blood pressure, it is recommended to consult a doctor and seek medical treatment in time to obtain professional advice and appropriate treatment plans.

Termination

We reserve the right to terminate this Agreement at any time for any reason at our sole discretion.

Upon termination, (a) the rights and licenses granted to you by this Agreement will terminate; (b) you must cease all use of the Application.
